Our Position
Surfolks displays public posts published by other people on LinkedIn and X. We do not host those posts and we do not control them, but we do cache and show excerpts, so we take copyright complaints seriously. If content that appears in Surfolks infringes your copyright, tell our designated agent and we will remove or disable access to it.
Designated Agent
Notices of claimed infringement should be sent to our designated copyright agent. We designate this agent to receive notices of claimed infringement under 17 U.S.C. § 512(c).
- Service: Surfolks
- Address: 17, 9th Street, Madipakkam, Chennai, Tamil Nadu 600091, India
- Email: copyright@surfolks.com
What a Takedown Notice Must Include
To be effective under 17 U.S.C. § 512(c)(3), your notice must be in writing and include all of the following:
- Your physical or electronic signature
- Identification of the copyrighted work you say is infringed
- The URL or other location of the material you want removed, specific enough for us to find it
- Your name, address, telephone number, and email address
- A statement that you have a good-faith belief the use is not authorised by the copyright owner, its agent, or the law
- A statement that the information in the notice is accurate and, under penalty of perjury, that you are the copyright owner or authorised to act for them
Incomplete notices may be returned. If you are unsure whether content infringes, get legal advice before sending — a knowingly false notice can create liability under § 512(f).
What We Do With a Notice
We review valid notices promptly, remove or disable access to the identified material, and notify the person who posted or submitted it where we can. If the material is a public post we fetched from LinkedIn or X, removing it from Surfolks does not remove the original post from that platform.
Counter-Notice
If your material was removed and you believe it was removed by mistake or misidentification, you can send a counter-notice to the same agent. It must include:
- Your physical or electronic signature
- Identification of the removed material and where it appeared before removal
- A statement under penalty of perjury that you have a good-faith belief the material was removed by mistake or misidentification
- Your name, address, and telephone number
- A statement that you consent to the jurisdiction of the federal district court for your address (or, if outside the United States, any judicial district in which we may be found), and that you will accept service of process from the person who sent the original notice
We may forward your counter-notice to the original complainant. If they do not notify us that they have filed a court action within 10 to 14 business days, we may restore the material.
Repeat Infringers
We terminate access for users who repeatedly infringe copyright. Repeated removal of the same material, or repeated valid notices against one account, can lead to suspension or termination.
